As we wait to see what will happen in the election it’s important not to forget that there are many cases still awaiting their chance at the supreme court with regard to equality. As I have written about many times before it is easy to get bogged down in the marriage issue but it is so much more than that. Todays link looks at it from a tax perspective.
This particular case looks at the fact that when one partner dies in a legal same-sex marriage estate tax is due, something that is not true in opposite sex marriages. That shifts the argument to one that clearly makes LGBTQ couples pay more tax that their straight counterparts, one that clearly is at odds with the Republican argument of reducing taxes when you consider their vehement refusal to repeal or re-examine DOMA. Lets hope that this inequality will also be dealt with at the same time as the marriage issue.
